License Agreement

You should carefully read the following terms and conditions before installation and use of this software. You are not required to accept this License, since you have not signed it. However, nothing else grants you permission to install and use this software. These actions are prohibited by law if you do not accept this License. Therefore, by installation of this software on your computer, you indicate your acceptance of this License and all its terms and conditions.

1. Disclaimer of Warranty

1.1. THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED.

1.2. IN NO EVENT SHALL OPENWORLD LEARNING, LLC BE LIABLE FOR DAMAGE OF ANY KIND, LOSS OF DATA, LOSS OF PROFITS, BUSINESS INTERRUPTION OR OTHER PECUNIARY LOSS ARISING DIRECTLY OR INDIRECTLY. ANY LIABILITY OF THE SELLER WILL BE EXCLUSIVELY LIMITED TO REPLACEMENT OF THE PRODUCT.

2. Third Parties Iintellectual Property Rights

2.1. THIS SOFTWARE MAY NOT BE USED FOR BACKWARD ENGINEERING AND ANY RELATED PURPOSES.

3. Evaluation and Activation

3.1. You may use this software without activation for evaluation purposes for the period of 30 days.

3.2. For your convenience you can purchase commercial license of FlashDigger Plus to open whole set of its features. Please read ORDER.TXT to find ordering information. As a result of software license purchasing, you'll get an activation information, opening the full features set of the software.

3.3. One activated copy of FlashDigger Plus may either be used by a single person who uses the software personally on one or more computers, or installed on a single workstation used nonsimultaneously by multiple people, but not both.

3.4. You may access the activated copy of FlashDigger Plus through a network, provided that you have obtained individual licenses for the software covering all workstations that will access the software through the network. For instance, if 8 different workstations will access FlashDigger Plus on the network, each workstation must have its own FlashDigger Plus license, regardless of whether they use FlashDigger Plus at different times or concurrently.

4. Order Refund Policy

4.1. Your order can be refunded instantly in the case, if the license was not activated (activation code was never used). Please do not activate the license, if you've placed an order by mistake, as a result of misunderstanding or if you can't find a required software feature. Please contact software technical support in such cases before a license activation. Activating your license you implicitly agree to use this software "AS IS" without any extra conditions and/or warranties.

4.2. Your activated license can be refunded only in the case, if you'll find a bug and/or misfunctioning in the FlashDigger Plus, leading to inability of its usage, according to the official user manual. In this case you must provide the full information, confirming the bug and/or misfunctioning, in the amount, enough to reproduce this bug and/or misfunctioning by the software developer. In this case your order will be refunded, if the software developer will unable to fix the problem within 48 hours, starting from the moment of full volume of necessary information receiving, and provide a bugfixing version of the FlashDigger Plus.

4.3. None of a third-party software bug and/or misfunctioning, causing a misfunctioning of the FlashDigger Plus, can be considered as a reason for refund request.

4.4. Openworld Learning, LLC, claims that FlashDigger Plus software is free from viruses/malware. It is officially confirmed by many independent software distributors.

4.5. None of antiviral software reports themself can be considered as a confirmation of virus/malware presence in the FlashDigger Plus software. Any such report must be confirmed by written and signed official investigation report. In this case Openworld Learning, LLC must provide a virus-free FlashDigger Plus software copy within 24 hours from the moment of such signed report receiving. Your order must be refunded, if Openworld Learning, LLC, will unable to provide the virus-free copy of the FlashDigger Plus software within the 24 hours term, pointed above.

4.6. Some of SWF files may be explicitly protected and/or encrypted by their authors in order to prohibit their unauthorized modification. In this case none of bugs/misfunctionings of the FlashDigger Plus software, caused by an attempt to load such protected/encrypted SWF file into the FlashDigger Plus software, may be considered, as a legal reason for the order refund request, because such attempt of the FlashDigger Plus software usage falls under Part #2.1 of this Agreement.
